Mother Sues Birth Control Patch Company for Daughters Death

The mother of a West Tennessee woman who died while she was using a popular birth control patch has filed a wrongful death lawsuit against the makers of the Ortho Evra patch.

The lawsuit names Ortho Evra developer and manufacturer Ortho-McNeil Pharmaceutical Company, a subsidiary of Johnson & Johnson. Ortho Evra was approved by the FDA in 2001. The birth control patch delivers the hormones estrogen and progestin directly to the bloodstream via the skin.

26-year-old Celena Devault, died from pulmonary embolism and blood clots in June 2003. She had been using the patch for two months. The plaintiff in the lawsuit is Devault's mother, Mary Devault.
